" Refresh of the directory of the astronomical observatories in Lombardy and determination of the relative bands of respect "

SEEN the regional law 27 March 2000, n. 17 " urgent Measures in topic of energetic saving to use of external lighting system and fight to the luminous pollution " and in particular the art. 5 that places in head to the Regional Committee the following implementations:

• the refresh of the directory of the astronomical and astrophysical observatories be them, professional and not, of regional or provincial importance from guardian;

• the determination of wraps of respect of the same observatories;

• the location, by means of cartography in adapted scale, of the security zones;

RECALLED the directory of which to the art. 10 of same l.r. the 17/00 that subdivides the observatories from guardian in three categories:

1. astronomical, astrophysical observatories professional;
2. not professional astronomical observatories of large cultural, scientific and popular importance of regional interest;
3. astronomical, astrophysical observatories not professional of provincial importance that carry out scientific activity and/or spreading;

• confirmation the suitability of the observatory astronomical " New Millennium Observatory " of Stumped (CO) to the registration in the third classified category to the not professional structures of provincial importance;

• the future putting in work of two new astronomical observatories is marked it calls " Ca to you de' Masses " of Saint Giovanni White man (BG) and Astronomical observatory of Tradate (CO);

TAKEN to verification ACTION carried out from the competent Organizational Unit, therefore as it previews the art. 5 of l.r. the 17/2000;

DATA ACTION that the location of the bands of respect for the three categories of observatories has assumed, like references, the experiences technical – scientific matured in within national and international that they have evidenced like the discouragement more consisting of the luminous emissions, equal to the 70 – 80%, are obtained taking part on distances of the order of 25 km, beyond which less obvious margins of mitigazione are had much and as for nearly the total removal of the luminous interferences it would be necessary to take part on ambles to you territorial many extending, species in zones strongly those of the Lombardy urbanizzate which;

THOUGHT, for the exposed motivations over, to fix the following bands of respect, understandings like beam from the considered observatory:

• not less than 25 km for the observatories of national importance, held also account that regional law 17/2000, also not imposing true and just the zero setting of the lights in such areas, arranges however one radical limitation of the emissions directed towards the high;

• not less than 15 km for the importance observatories regional, waves to achieve one medium reduction of the equal polluting emissions to the 55 – 60%;

• not less than 10 km for the importance observatories provincial, waves to achieve one medium reduction of the equal polluting emissions to 50%;

TAKEN ACTION that the Leader of the competent Organizational Unit for matter characterizes the appraisals and determination of which over like first regulation of the art. 5 of l.r. the 17/00, reserving itself see again the same ones in dependency of eventual norms, also technical, or directives or resolutions that had to interest the specific argument;

WINNOWED and ASSUMED like own the foretold appraisals and determination;

DATA ACTION that the present provision is not subject to control to the senses of the art. 17 of law n. 127 of 15 May 1997;

1. to modernize the directory of the observatories from guardian of which to the art. 10 of l.r. the 17/2000, inserting, in the second category, the astronomical observatory " New Millennium Observatory " of Stumped (Co), in how much not professional structure of provincial importance;
2. to correct the denomination of the structure already inserted in the directory like " Observatory of Rest Top – Masaga (Bs)" in " Astronomical Observatory of Top Rest di Magasa (BS)";
3. to assign to the observatory of which to previous point 2, in dependency of the logistic oneness, characterized they give an altitude of 1350 m s.l.m. in full regional Park of the Garda High Bresciano, and of its scientific and cultural vocation, the valence of not professional of provincial importance, typical structure of the second category;
4. to characterize, for every single category of belongings of the observatories, the bands of premised respect already indicated in and of continuation recalled:
